Our client is a private hospital.
They are seeking a Head of Legal to oversee all legal matters for the hospital, ensuring compliance with healthcare regulations, managing contractual agreements, and mitigating legal risks. This role requires a strategic legal advisor who can provide expert guidance to hospital leadership on legal issues related to patient care, employment law, corporate governance, and risk management.
Responsibilities:
- Ensuring the hospital operates in compliance with relevant laws and regulations, including healthcare laws, privacy regulations (HIPAA), and labour laws.
- Regularly reviewing and updating hospital policies and procedures to reflect legal changes.
- Drafting, reviewing, and negotiating contracts with vendors, healthcare providers, insurance companies, and other stakeholders.
- Establishing standard contract templates and guidelines for various legal agreements.
- Managing and overseeing all litigation matters involving the hospital, including working with outside counsel as necessary.
- Developing strategies for dispute resolution and risk mitigation.
- Identifying potential legal risks and advising senior management on strategies to mitigate them.
- Collaborating with other departments to implement and monitor compliance initiatives.
- Providing legal advice regarding corporate governance, including board meetings, policy development, and regulatory compliance.
- Assisting in the preparation of legal documents for the board of directors and other governance bodies.
- Developing and implementing training programs for staff on legal compliance and ethical standards.
- Creating and disseminating guidelines to address legal issues unique to the healthcare environment.
- Serving as the primary legal advisor to the hospital management team on matters related to patient care and treatment.
- Guiding on emerging legal issues, including telehealth, medical malpractice, and patient consent.
- Liaising with regulatory agencies, external legal counsel, and other stakeholders on legal matters affecting the hospital.
- Representing the hospital in legal proceedings, negotiations, and public hearings when necessary.
Qualifications:
- Degree in Law with a Lawyer's License.
- Admission to the bar; healthcare law experience is preferred.
- Minimum of 7-10 years of legal experience, with a focus on healthcare law, corporate law, or regulatory compliance.
- Strong understanding of hospital operations and healthcare regulations.
- Excellent analytical, negotiation, and communication skills.
- Proven ability to work collaboratively with internal and external stakeholders.
- Strong decision-making abilities and strategic thinking.
